1. Scope of License

1.1.By purchasing a product, the Buyer obtains a non-exclusive and non-transferable right to use the product within the scope agreed for the specific order, product or license.
1.2.Unless expressly stated otherwise, one license entitles the Buyer to use the product on one production website or e-shop, meaning one domain or subdomain.
1.3.The license is valid only after the product or service price has been duly and fully paid.

2. Test and Development Environment

2.1.The Buyer may use the product in a test or development environment if that environment is used to verify, install, modify or prepare the same project for which the license was purchased.
2.2.Test use must not be used to operate another independent production e-shop or to provide the product to third parties.

3. Multiple Licenses

3.1.If the Buyer wants to use the same product on multiple production websites, e-shops, domains or subdomains, the Buyer must purchase the corresponding number of licenses unless another license model is stated for the product.
3.2.Any volume discount or preferential price for multiple licenses is governed by the price and conditions stated for the specific product or by individual agreement.

4. Prohibited Use

4.1.The Buyer is not entitled in particular to:
  • grant sublicenses to the product or rent, lend or transfer it to third parties,
  • sell, broker the sale of or offer the product as the Buyer's own solution,
  • make the product publicly available, offer it for download, share it or distribute it,
  • copy the product for other projects beyond the purchased license,
  • remove or bypass protective, license or identification mechanisms of the product.

5. Product Modifications

5.1.The Buyer may modify the product for the Buyer's own use and for the project for which the license was purchased, provided that this does not infringe the Supplier's copyright or the license conditions.
5.2.Modification of the product does not give the Buyer copyright to the original product or the right to further sell, provide, distribute or present the modified version as the Buyer's own work.

6. Copyright

6.1.Copyright and other intellectual property rights to the products belong to the Supplier or, where stated for a specific product, to other authorized persons.
6.2.The product is protected by copyright and unauthorized use may give rise to the Supplier's right to demand cessation of the infringement, removal of consequences, compensation for damage, surrender of unjust enrichment or reasonable satisfaction.

7. Free Products

7.1.Products, sample files or add-ons provided free of charge may be provided without any entitlement to support, updates, maintenance or compatibility warranty unless expressly stated otherwise.
7.2.Free products are used at the Buyer's responsibility. Before installation or modification of the e-shop, the Buyer must ensure a current backup of files and the database.

8. Updates and Support

8.1.Updates, support, installation, custom modifications, implementation, testing or service interventions are not automatically included in the license unless stated for the product or agreed separately.
8.2.Support is provided mainly for the current version of the product or the version supported by the Supplier and in a compatible environment. It does not apply to errors caused by third-party modules, themes, unsuitable hosting, an outdated PrestaShop version, third-party interventions or modifications outside the Supplier's control.

9. License Breach

9.1.Use of the product beyond the purchased license, providing it to a third party, sharing, resale or public availability is considered a breach of the license terms.
9.2.In the event of a breach of the license terms, the Supplier is entitled to demand termination of unauthorized use, removal of consequences, compensation for damage, lost profit and other claims arising from legal regulations.
